Mrs. Justice Cox has given an insurer, represented by William Featherby Q.C., permission to proceed against a former claimant for contempt of court. She held that the insurers had a strong prima facie case against the claimant. The contempt proceedings arise out of what the insurers allege is a stark mismatch between the claimant's complaints of disability in witness statements, reflected in a claim for over £800,000 damages after a road accident, and the reality when she was filmed by enquiry agents. Cox J held that the claimant's contempt could not be expunged by the fact that her claim had been compromised (the insurers having paid her £25,000 but with an order for costs against her).
