Beddoes and others v Vintners Defence Systems and others
In Beddoes and others v Vintners Defence Systems and others, the Claimants, who had been diagnosed as having asbestosis but had not yet developed any symptoms or disability, were held to have suffered actionable harm and were entitled to recover damages. The defence argument that claims did not become actionable until either there were symptoms or there was some other perceptible effect, was rejected. The claimants were represented by Allan Gore QC and Simon Levene, who were instructed by Robinson Murphy of Newcastle.
