The Cayman Islands seem a very long way from 12 King’s Bench Walk. However, for the next 6 weeks 12KBW will have an annexe there. There are only three courts in the Cayman Islands and while Andrew Hogarth QC is appearing for the “Plaintiff” in one of the courts, Richard Davison will be appearing for the “Plaintiff” in the court next door. I suspect that they have packed their sunglasses.

Stress Claim Struck Out
In Julie Jones v Caerphilly CBC, HHJ Hickinbottom struck out a stress at work claim on 7/4/06. The claimant had brought a successful claim for unfair dismissal relying upon the same facts as those which underpinned her common law claim. The court found that she was issue estopped from contending that those facts did not form part of the fact of or manner of her dismissal. As a result her claim fell within the so-called Johnson exclusion area and she was prevented from bringing a claim in tort. Recognising that the case raises important issues, the judge granted permission to appeal, but a decision on whether an appeal will in fact be pursued is awaited.

Nicholas Heathcote Williams and Quintin Tudor-Evans in important High Court case on the Highway Authority's duties under section 41 of the Highways Act 1980
HH Judge Seymour QC's decision in this case means that subject only to the specific statutory amendment w.e.f. 31 October 2003 regarding snow and ice, a highway authority’s duty under Section 41 of the Highways Act 1980 is simply to maintain the physical surface of the highway itself. The highway authority has no duty to maintain drainage so as to prevent or remove a flood, however dangerous that may be, which is unrelated to any defect in the physical surface of the highway. This decision has far reaching implications and leave to appeal was granted. To read a full case note please click here.

In what has been described in the national press as a landmark decision, a High Court Judge yesterday committed a man to prison for 14 days for contempt of court for attempting to bring a fraudulent claim for damages for personal injury, and stated that those who pursue fraudulent claims in the future can expect to receive immediate prison sentences of substantially longer terms in the absence of very good mitigation.

12KBW success in Court of Appeal
On 6 December 2005 the Court of Appeal threw out an appeal by a man who had fallen from a sloping grass bank into an unfenced pedestrian subway and suffered serious brain injuries. The Court of Appeal found in Maloney v Torfaen CBC that the Council, represented by 12KBW’s Catherine Brown, owed no duty of care to Mr Maloney who tried to take a shortcut down the bank to his flat at about midnight when he was very drunk.
