An analysis of the principles set out in McDermid v Nash Dredging & Reclamation Co Ltd [1987] AC 906 and Newton-Sealey v Armor Group Services Ltd [2008] EWHC 233 and the recent cases of Dusek v Stormharbour [2015] EWHC 37 (QBD) and Cassley v GMP Securities Europe LLP [2015] EWHC 722 (QBD).
